By using this website or buying a package, you agree to these terms.
1. What ProbatePrep is
ProbatePrep is self-help software. It gives legal information and prepares documents from answers you provide and confirm. It is not a law firm, and it does not provide legal advice or legal services. Using ProbatePrep does not create a lawyer–client relationship. Our full disclaimer is part of these terms.
2. You represent yourself
You are preparing and filing your own court application. You must review every answer and every generated document before signing or filing it. You confirm your answers are true and complete — the court forms are sworn documents, and swearing something false has legal consequences.
3. Accounts
Sign-in uses email links — there are no passwords. Keep access to your email safe; anyone with your email link can open your account. You must be at least 18 and able to manage your own affairs to use the service.
4. Payment
The interview is free. You pay when your package is ready: $199 (Small Estate) or $449 (Standard), plus sales tax (HST/GST) based on where you live, in Canadian dollars, through Stripe. We never see or store your card number. Prices may change, but never for a purchase you have already made.
There is one optional extra: the Package Check, $79 plus tax. It is an automated check that looks over your finished package against a list of known filing problems before you send it to the court, and you can run it again as often as you like for 12 months. It is never added to your order unless you tick the box yourself. It is software, not a person, and it is covered by these terms and the same promise below.
5. Our promise (guarantee)
If the court returns your application because of a fixable error in documents we generated from answers you confirmed, we fix the error and regenerate your package free, for 12 months from purchase. Details on the promise page. This is the only guarantee we make: we cannot and do not promise the court will grant a certificate.
5a. Refunds and cancellations
Because the interview is free and you pay only at the moment your finished package is built and delivered, there is no waiting period between paying and receiving what you paid for. Our policy when something goes wrong is to fix it: if the court returns your application because of a fixable error in our documents, we correct it and rebuild your package at no charge under the promise above.
We do not offer automatic money-back refunds once your package has been delivered. If you believe something is genuinely wrong with what you received, email support@probateprep.ca — a person will look at it within one business day, and we deal with honest problems honestly, case by case. Nothing in this section takes away any refund or cancellation right that Ontario consumer protection law gives you and does not allow us to limit.
6. Your documents and data
Purchased packages stay available to download for 12 months, then are deleted. Unfinished interviews are deleted after 12 months of inactivity. You can delete everything yourself at any time — immediately and permanently — from your account. Our privacy policy explains how your information is protected.
7. Fair use
One purchase covers one estate. Don't misuse the service: no false information, no attempting to breach security, no reselling generated packages.
8. Limits of our responsibility
We work hard to keep the software correct and current, checking the official forms and rules regularly. Still, to the extent Ontario law allows: the service is provided "as is"; we are not responsible for court decisions, delays, or outcomes; and our total liability for any claim is limited to the amount you paid us. Nothing in these terms limits rights that Ontario consumer protection law says cannot be limited.
9. Changes and contact
If we change these terms, we'll post the new version here with a new date. The version in force when you purchase governs that purchase. These terms are governed by the laws of Ontario. Questions: support@probateprep.ca.
